Refund and Returns Policy

At FIZABEE LLC, we provide customized mobile application development and digital services based on each client’s specific requirements. Because our services involve professional time, planning, design, development, testing, technical work, and customized deliverables, our refund and cancellation terms are designed specifically for digital and service-based projects.

By purchasing or engaging FIZABEE LLC for services, you acknowledge and agree to the terms of this Refund and Return Policy.

1. About FIZABEE LLC

FIZABEE LLC
1209 MOUNTAIN ROAD PL NE STE R
ALBUQUERQUE, NM 87110
United States

Email: hello@fizabee.com
Website: https://fizabee.com/

FIZABEE provides:

  • Custom iOS & Android App Development

  • Cross-Platform App Development

  • Mobile UI/UX Design & Prototyping

  • App Testing, Deployment & Optimization

  • Related development and technical services

Our packages are generally provided through a one-time payment model rather than recurring subscriptions.

2. Nature Of Our Services

FIZABEE provides customized digital and software development services.

Unlike physical products, our services may involve work that begins shortly after payment, including:

  • Project planning

  • Requirements analysis

  • UI/UX design

  • Prototyping

  • Software development

  • Coding

  • Configuration

  • Testing

  • Optimization

  • Technical consultation

  • Deployment preparation

  • Project communication

Because these services involve professional work and customized deliverables, they cannot always be “returned” in the same way as physical products.

3. No Automatic Refund After Work Begins

Once work on a project has started, payments are generally non-refundable, except where a refund is expressly required by applicable law or agreed upon in writing.

Work may be considered started when FIZABEE begins activities such as:

  • Requirements analysis

  • Project planning

  • UI/UX design

  • Prototyping

  • Development

  • Coding

  • Testing

  • Technical setup

  • Project research

  • Integration work

  • Other agreed project activities

The reason for this policy is that professional resources may already have been allocated to the project.

4. Cancellation Before Work Begins

If you request cancellation before meaningful project work has started, FIZABEE may review the request on a case-by-case basis.

Where a refund is approved, the refundable amount may be reduced by:

  • Payment processing fees

  • Third-party fees already incurred

  • Administrative costs

  • Work already performed

  • Other non-recoverable project expenses

Any approved refund will be processed using the original payment method where reasonably possible.

5. Cancellation After Work Begins

If a client cancels a project after work has started, the client may remain responsible for payment for work already completed or committed.

Depending on the project stage, this may include charges for:

  • Completed designs

  • Completed development

  • Completed testing

  • Project planning

  • Research

  • Prototyping

  • Integrations

  • Technical configuration

  • Third-party services

  • Other completed or committed work

Any potential refund will be evaluated based on the specific project circumstances and applicable agreement.

6. Completed Deliverables

Once a deliverable has been completed and provided to the client, payment for that deliverable is generally non-refundable.

Examples may include:

  • Completed UI/UX designs

  • Approved prototypes

  • Completed application features

  • Completed source-code work

  • Testing reports

  • Deployment preparation

  • Other agreed project deliverables

Clients are encouraged to review deliverables carefully and communicate concerns promptly.

7. Client-Requested Changes

Clients may request changes during a project.

Changes that fall within the agreed scope may be handled according to the applicable project agreement.

Requests that substantially change the original scope may require:

  • Additional fees

  • A revised quotation

  • A revised timeline

  • Additional development

  • Additional design work

Payments for work already completed are not automatically refundable because the client later changes project requirements.

8. Delays Caused By The Client

Refunds may not be available when delays or project difficulties are caused by client-related circumstances.

Examples include:

  • Delayed feedback

  • Delayed approvals

  • Failure to provide required information

  • Failure to provide necessary access

  • Changes in requirements

  • Delayed payments

  • Unavailability of required third-party accounts

  • Missing project materials

FIZABEE may reasonably adjust project timelines when client delays affect delivery.

9. Third-Party Services And Fees

Some projects may depend on third-party services.

Examples include:

  • Apple App Store

  • Google Play

  • Hosting providers

  • Cloud platforms

  • Payment processors

  • APIs

  • Maps

  • Authentication services

  • Analytics platforms

  • Software libraries

  • Other external technology services

Fees paid to third parties are generally non-refundable through FIZABEE.

FIZABEE is not responsible for refunds resulting from:

  • Third-party service cancellation

  • Platform rejection

  • Platform policy changes

  • Third-party outages

  • API changes

  • Service discontinuation

  • Third-party account restrictions

  • Changes to third-party pricing

Where a third party controls a payment or service, the applicable third party’s refund policy may apply.

10. App Store Rejection

FIZABEE may provide application deployment or submission support when included in the purchased package.

However, Apple, Google, or another third-party platform ultimately controls application approval.

If an application is rejected by an app marketplace, this does not automatically qualify the client for a refund.

If changes are required because of platform requirements, the parties may determine whether those changes fall within the agreed scope or require additional work.

11. Technical Issues

If a delivered application contains an issue that falls within the agreed project scope, FIZABEE may review and address the issue according to the applicable project agreement.

A technical issue does not automatically create a right to a refund.

Where appropriate, FIZABEE may choose to:

  • Correct the issue

  • Provide a reasonable workaround

  • Reconfigure the affected functionality

  • Investigate the cause

  • Provide another reasonable solution

The appropriate remedy depends on the nature of the issue and the agreed project scope.

12. Bugs And Defects

If a client identifies a genuine defect in an agreed deliverable, the client should notify FIZABEE as soon as reasonably possible.

The issue should include enough information for us to understand and reproduce the problem where possible.

We may request:

  • Screenshots

  • Screen recordings

  • Device information

  • Operating system information

  • Steps to reproduce the issue

  • Error messages

  • Other relevant technical information

Where the issue is determined to be within our agreed responsibility, we will make reasonable efforts to address it according to the project agreement.

13. Change Of Mind

Refunds are generally not provided solely because a client changes their mind after customized work has begun.

This includes situations where:

  • The client changes business direction

  • The client no longer wants the application

  • The client decides not to launch

  • The client changes their target audience

  • The client chooses another development provider

  • The client decides not to continue the project

Because customized professional work may already have been completed, payments associated with completed work generally remain non-refundable.

14. Duplicate Payments

If you accidentally make a duplicate payment for the same invoice or service, please contact us promptly.

After verifying the duplicate transaction, FIZABEE may issue a refund for the verified duplicate amount, subject to applicable payment processing considerations.

15. Unauthorized Transactions

If you believe a payment was made without your authorization, contact us immediately at:

hello@fizabee.com

We may request information necessary to investigate the transaction.

If the payment was processed through a third-party payment provider, that provider’s dispute and investigation procedures may also apply.

16. Refund Request Process

To request a refund or raise a billing concern, contact us by email:

hello@fizabee.com

Your request should include:

  • Full name

  • Company name, if applicable

  • Invoice or order information

  • Service or package purchased

  • Payment date

  • Reason for the request

  • Relevant project information

  • Supporting documentation, if applicable

Providing complete information can help us review the request more efficiently.

17. Refund Review

Each refund request may be reviewed based on:

  • The applicable project agreement

  • Amount of work completed

  • Project stage

  • Payment status

  • Deliverables already provided

  • Client-requested changes

  • Third-party costs

  • Project delays

  • Applicable law

  • Other relevant circumstances

Approval of one refund request does not create an automatic right to a refund in another situation.

18. Refund Processing

If a refund is approved, we will generally process it using the original payment method where reasonably possible.

The time required for the refund to appear in your account may depend on:

  • Payment provider

  • Bank

  • Card issuer

  • Payment method

  • Processing systems

FIZABEE cannot control delays caused by financial institutions or third-party payment processors.

19. Non-Refundable Costs

Unless otherwise required by applicable law or agreed in writing, the following may be non-refundable:

  • Completed development work

  • Completed design work

  • Completed prototypes

  • Completed testing

  • Technical consultation already provided

  • Third-party fees

  • Platform fees

  • Payment processing fees

  • Hosting fees

  • Domain fees

  • API costs

  • Licensing costs

  • Other project expenses already incurred

20. No Returns For Digital Services

Because FIZABEE primarily provides digital and professional services rather than physical products, traditional product returns do not apply.

Digital deliverables cannot generally be returned after they have been created, transferred, accessed, or used.

Refund eligibility is therefore determined according to the service agreement, project status, work completed, and applicable law.

21. Package Upgrades

If a client wants to upgrade from one package to another, the request may be reviewed based on the project’s current status.

Any additional amount required for the upgraded package will be communicated before the additional work begins.

Previously completed work is not automatically refunded when a package is upgraded.

22. Package Downgrades

If a client requests to downgrade a package after work has started, the request may be evaluated based on the amount of work already completed and the applicable project agreement.

A downgrade does not automatically create an entitlement to a refund.

23. Project Termination By FIZABEE

FIZABEE may terminate or suspend a project where reasonably necessary due to:

  • Non-payment

  • Material breach of agreement

  • Unlawful activity

  • Abusive conduct

  • Misuse of services

  • Security concerns

  • Repeated failure to cooperate

  • Other serious project-related circumstances

If FIZABEE terminates a project, any refund or outstanding payment obligations will be determined based on the applicable agreement, work completed, circumstances of termination, and applicable law.

24. Fraudulent Refund Requests

We reserve the right to reject refund requests that appear fraudulent, abusive, deceptive, or inconsistent with the actual project circumstances.

This may include attempts to:

  • Obtain completed work without payment

  • Misrepresent project status

  • Submit false information

  • Repeatedly abuse refund procedures

  • Use payment disputes improperly

We may take appropriate action to protect our business and rights.

25. Chargebacks And Payment Disputes

Before initiating a payment dispute or chargeback, we encourage clients to contact FIZABEE at hello@fizabee.com so we can attempt to resolve the issue.

If a chargeback is initiated, we may provide relevant documentation to the payment processor or financial institution, including:

  • Invoices

  • Project agreements

  • Payment records

  • Communication records

  • Evidence of completed work

  • Deliverables

  • Other relevant documentation

Nothing in this section limits any rights available to consumers under applicable law.

26. Consumer Rights

Nothing in this Refund and Return Policy is intended to remove or restrict any mandatory rights you may have under applicable consumer protection laws.

Where applicable law provides a non-waivable right to a refund, cancellation, remedy, replacement, or other protection, that legal right will apply.

27. No Guarantee Of Specific Business Results

Refunds are not generally provided because a completed application does not achieve a particular business outcome.

FIZABEE does not guarantee specific:

  • Revenue

  • Profit

  • Downloads

  • App rankings

  • Customer numbers

  • Conversion rates

  • Market share

  • Return on investment

Business performance depends on many factors outside our control.

28. Privacy And Payment Information

Personal information associated with refund requests and transactions will be handled according to our Privacy Policy and applicable law.

Payment information may be processed by third-party payment providers.

We encourage clients to review the applicable privacy and payment policies of those providers.

29. Policy Changes

FIZABEE may update this Refund and Return Policy from time to time to reflect:

  • Changes in services

  • Changes in payment procedures

  • Changes in business practices

  • Changes in applicable law

  • Improvements to our policies

The updated policy will display a revised “Last Updated” date.
